ALL THOSE certain two lots of land, with the buildings and improvements thereon now numbered 2912 Vardun Avenue, situated in the City of Norfolk, Virginia, and designated as Lots Numbered Twenty-five (25) and Twenty-six (26) in Block Twenty-four (24) on the plat of Fairmont Park, of record in the Clerk's Office of the Circuit Court of Chesapeake (formerly Norfolk County), Virginia, in Map Book 6, at pages 35 and 36, and are more particularly described as beginning at a point on the eastern side of Verdun (formerly Fourth Street) Avenue seven hundred twenty (720) feet south from the southern line of Kitchener Avenue; running thence southwardly along the eastern side of Verdun Avenue Sixty (60) feet; eastwardly, parallel with Kitchener Avenue One Hundred (100) feet; thence northwardly, parallel with Verdun Avenue, sixty (60) feet; thence westwardly, parallel with Kitchener Avenue, One Hundred (100) feet to the point of beginning. LESS AND EXCEPT that portion of the above described property conveyed out by deed of W. Floyd Combs and Ruth A. Combs, his wife, dated June 16, 1950 and recorded in the Clerk's Office of the Circuit Court of the City of Norfolk, Virginia in Deed Book 1105, page 319.1

TERMS OF SALE: A non-refundable bidder's deposit of $9,500.00 or 10% of the sale price, whichever is less, by cashier's or certified check required at time of sale, except for the party secured by the Deed of Trust. Risk of loss is on the purchaser from date and time of auction. Balance of the purchase price must be paid by cashier's check within 14 days from sale date. Except for Virginia Grantor tax, all settlement costs and expenses are purchaser's responsibility. Taxes are pro-rated to the date of sale. Purchaser is responsible for obtaining possession of the property. If purchaser defaults, deposit may be forfeited and property resold at the risk and cost of the defaulting purchaser who shall be liable for any deficiency in the purchase price and all costs, expenses, and attorney's fees of both sales.
