Pursuant to the terms of a deed of trust dated July 16, 2020, in the original principal amount of $264,127.00, recorded in the Clerk's Office of the Circuit Court of the City of Chesapeake, Virginia, in Deed Book 10183, Page 0005, as Instrument No. 200023592, as assigned to Noteholder by Assignment of Deed of Trust, recorded in Deed Book 10653, Page 1572, as Instrument No. 230007561, the property briefly described below will be offered for sale at public auction:
PARCEL I: ALL THAT certain lot, piece or parcel of land, with the buildings and improvements thereon, situate, lying and being in the Deep Creek Borough of the City of Chesapeake, Virginia, and known, numbered and designated as Lot "A", on that certain plat entitled "Resubdivision of Lots 7, 8 and 9 (previously erroneously referred to as Lots 7 and 8), Elizabeth Gardens, for Hubert A. and Eva L. Smith, located in the Deep Creek Borough of the City of Chesapeake", dated February 11, 1967, made by Freeman and Johnson, Engineers and Surveyors, of record in the Clerk's Office of the Circuit Court of the City of Chesapeake, Virginia, in Deed Book 1494, at page 227. Reference to which is hereby made for a more particular description hereof. PARCEL II: ALL THAT certain lot, piece or parcel of land situated in the Deep Creek Borough, Chesapeake, Virginia, and known, numbered and designated as Lot E on that certain plat entitled, "Subdivision of ELIZABETH GARDENS, Deep Creek Borough, Chesapeake, Virginia", dated October 15, 1978, and made by Wilfred P. Large, Surveying and Planning, Virginia Beach, Virginia. Said plat is duly recorded in the Clerk's Office of the Circuit Court of the City of Chesapeake, Virginia, in Map Book 66, at Page 53. Reference to which is hereby made for a more particular description thereof., and as more particularly described in the referenced deed of trust.
The sale will take place on APRIL 24, 2024, AT 12:30 P.M., at the front entrance to the building housing the Circuit Court of the City of Chesapeake, located at 307 Albemarle Drive, Chesapeake, VA. The undersigned reserves the right to suspend bidding and/or to adjourn the bidding prior to the completion of sale.
The property and the improvements thereon will be sold "AS IS" and without representation or warranties of any kind. The sale is subject to all liens, encumbrances, conditions, easements and restrictions, if any, superior to the mentioned deed of trust and lawfully affecting the property.
Terms: A deposit in the form of CERTIFIED FUNDS in the amount of $10,000.00 (CASH NOT ACCEPTED) or 10% of the successful bid, whichever is lower, is required of any bidder at the time of sale. Closing within fifteen (15) days of sale. If the payment of the balance does not occur within fifteen days of sale, the deposit shall be retained by the Trustee as liquidated damages. Time is of the essence. Trustee has no duty to obtain possession for purchaser. The risk of loss or damage to the property passes to the purchaser immediately upon conclusion of the Substitute Trustee's sale. Purchaser to pay all closing costs, including cost of Trustee's Deed.
