In execution of a certain Deed of Trust, Assignment of Rents, Security Agreement and Fixture Filing dated February 28, 2023 and recorded in the Clerk's Office of the Suffolk Circuit Court on March 1, 2023 as Instrument 230001985 (the "Deed of Trust"), the undersigned Substitute Trustee will offer for sale at public auction at the courthouse steps of the courthouse for the Suffolk Circuit Court, 150 North Main Street, Suffolk, VA 23434 on May 14, 2024, at 10:00 a.m., and via simultaneous online bidding at https://walkercommercialservices.bidwrangler.com/ui, certain property described in said Deed of Trust, located at the above address, and more particularly described as follows:
All that certain lot of land situated in the City of Suffolk (formerly Holy Neck Magisterial District Nansemond County), Virginia, the same being designated on a plat of that certain tract of land belonging to E.L. Folk, deceased, part of property of E.L. Folk Estate in Saratoga Place, as surveyed by Brinkley and Riddick, 1908, and described as follows: Being Lot No. Five (5), with the improvements thereon, in Block 1, Reference to which plat made by Brinkley and Riddick, 1908 revised by T.R. Petit, C.E. in May 1927, is hereby made, said plat being recorded in the Clerk's Office of the Circuit Court of the City of Suffolk, Virginia in Plat Book 3, Page 84.
Sale is subject to all prior liens, easements, restrictions, covenants, and conditions, if any, of record, or other matters which would be disclosed by an accurate survey or inspection of the premises.
TERMS: Prior to the sale, interested bidders will be required to register and must present a bid deposit in the amount of 10% of his or her highest expected bid price, which may be held during the sale by the Substitute Trustee. Deposit to be paid via certified check only. The successful bidder's deposit will be applied to the purchase price at closing and is non-refundable unless the Substitute Trustee cannot convey title. If held by the Substitute Trustee, all other bid deposits will be returned to the unsuccessful bidders. Five percent (5%) buyer's premium in effect on day of sale. The balance of the purchase price shall be due in cash. Closing to take place within 30 days of sale. Time is of the essence. The Property will be conveyed by Special Warranty Deed and is sold "Where-Is, As-Is." The successful bidder will be responsible for obtaining possession of the property, and for all costs and fees related to drafting, executing, and recording the Trustee's Deed, including the grantors tax. In the event that the holder of the Deed of Trust, an affiliate, or servicer thereof, or an assignee of any of them, is the successful bidder at the sale, such party will not be required to make a deposit or to pay interest on the unpaid purchase money. Taxes, water, rent and all other municipal charges and liens owed against the Property shall be the responsibility of the purchaser and shall be paid by the purchaser at settlement. The cost of all documentary stamps, recordation taxes, document preparation and transfer taxes is to be paid by the purchaser. The Trustee reserves the right to reject any and all bids, and to extend the time for settlement, if applicable. Announcements made on the day of sale by Substitute Trustee and/or auctioneer take precedence over all prior communications and announcements concerning the sale or the Property.
