In execution of the Deed of Trust in the original principal amount of $186,558.00 dated March 22, 2023 and recorded as Instrument No. 230004679, of the City of Norfolk land records, the appointed Substitute Trustee will offer for sale at public auction at the entrance to the Courts Building, 150 St. Paul's Boulevard, Norfolk, Virginia 23510 on April 30, 2024 at 10:30 AM, the property described in said deed of trust, located at the above address and more particularly described as follows::
ALL THAT certain lot, piece or parcel of land, with the buildings and improvements thereon, and appurtenances thereunto belonging, numbered 9202 Portal Road, (formerly 9104 Portal Road), situate in the City of Norfolk, Virginia, and being known and numbered as Lot Number Two (2), on the Plat of Devon Manor Section One (1), made by James H. Starkey, C.E., and recorded in the Clerk's Office of the Circuit Court and the City of Chesapeake, Virginia (formerly Norfolk County, Virginia) in Map Book 26, at pages 91 and 92.
IT BEING the same property conveyed to James Justin Johnson and Gail T. Johnson, husband and wife by deed of Benjamin F. Brinn, Jr., sole acting trustee if the Benjamin F. Brinn, Jr. Revocable Trust, dated 11/16/22, recorded 11/17/22, in the Clerk's Office of the Circuit Court of the City of Norfolk, Virginia, in Instrument #220026898
IT FURTHER BEING the same property conveyed to Benjamin F. Brinn, Jr and Virginia Hudgins Brinn, Trustees of the Benjamin F. Brinn, Jr. Revocable Trust by deed of Benjamin F. Brinn, Jr. Trustee of the Benjamin F. Brinn, Jr. Revocable Trust, dated 05/28/98, recorded 06/08/98, in the aforesaid Clerk's Office in Deed Book 3039, at page 757. The said Virginia Hudgins Brinn having departed this life on August 3, 2016 leaving Benjamin F. Brinn, Jr. as the sole acting Trustee.
The property and improvements will be sold in "as is" physical condition without warranty of any kind.
TERMS OF SALE: A non-refundable bidder's deposit of 10% of the sale price or 10% of the original principal amount of the subject Deed of Trust, whichever is lower, by cashier's or certified check, required at time of sale except for the party secured by the Deed of Trust. Risk of loss on purchaser from date and time of auction. Balance of the purchase price must be paid by cashier's check within 15 days from sale date. Except for Virginia Grantor's tax, all settlement costs and expenses are purchaser's responsibility. Taxes are pro-rated to the date of sale. Purchaser is responsible for obtaining possession of the property. If purchaser defaults, deposit may be forfeited and property resold at the risk and cost of the defaulting purchaser who shall be liable for any deficiency in the purchase price and all costs, expenses and attorney's fees of both sales. If Trustee does not convey title for any reason, purchaser's sole remedy is return of deposit without interest. This sale is subject to post-sale audit by the Substitute Trustee of the conduct of the auction itself as well as the status of the loan secured by the Deed of Trust, including, but not limited to, determining whether prior to sale a bankruptcy was filed, a forbearance, repayment or other agreement was entered into or the loan was reinstated or paid off; in any such event this sale shall be null and void and purchaser's sole remedy shall be return of deposit without interest.
