In execution of certain Memoranda of Liens delivered by The Historic Powhatan Resort Owners Association and Greensprings Vacation Resort Owners Association (the "Associations"), against certain time-share estates (the "Time-share Estates"), which are duly recorded in the Clerk's Office of the Circuit Court of the City of Williamsburg and the County of James City, Virginia (the "Clerk's Office"), the owners thereof having failed to pay the maintenance fees and assessments, both regular and special, due to the Associations and applicable to each Time-share Estate, the undersigned, as duly appointed Trustee for the Associations and in accordance with §55.1-2211 of the Virginia Code, will offer for sale at public auction in front of the building housing the Circuit Court for the County of James City and City of Williamsburg, located at 5201 Monticello Avenue, Williamsburg, VA on April 9, 2024 at 11:30 a.m., the Time-share Estates at those certain time-share projects known as (i) The Historic Powhatan Resort formerly known as Powhatan Plantation, located at 3601 Ironbound Road, Williamsburg, VA 23188, as more fully described in that certain Timeshare Instrument for Powhatan Plantation, dated January 22, 1984 and duly recorded in the Clerk's Office in Deed Book 253, Page 190, as amended and supplemented from time to time; and (ii) Greensprings Vacation Resort, located at 3500 Ludwell Parkway, Williamsburg, VA 23188, as more fully described in that certain Time-Share Instrument for Greensprings Plantation Resort, A Vacation Ownership Resort, made by Greensprings Associates, dated as of June 30, 1995, recorded in the aforesaid Clerk's Office in Deed Book 749, Page 67, as amended and supplemented from time to time. The full list of Time-share Estates to be sold, their Parcel IDs, and the Memoranda of Lien recording information, which further describe the particular Time-share Estates, can be found on the Foreclosure page of www.glasserlaw.com, at the Timeshare Sales link. The sale shall be made subject to all existing liens, encumbrances, easements and restrictive covenants as they may lawfully affect the subject property. The purchaser is bound to the terms and conditions contained in the time-share instruments, bylaws, and regulations. TERMS: CASH. Each Time-share Estate shall be sold separately. A bidder's deposit of 33.33% of the sale price is required as to each Time-share Estate. Prior to the sale, interested bidders will be required to register with and must present a bid deposit to the trustee. The bid deposit must be certified funds and/or cash. Settlement is to be made within 15 days. The successful bidder will be required to execute a Memorandum of Trustee's Sale, available for review on the Foreclosure page of www.glasserlaw.com, outlining additional terms of sale and settlement. A Trustee's Deed will be prepared by Trustee's attorney as high bidder's expense.
