TRUSTEE'S SALE 1209 Funnell Street Virginia Beach, VA 23455 In execution of the Deed of Trust dated August 2, 2007 and recorded on August 7, 2007 in Instrument # 20070807001074870 of the City of Virginia Beach land records, Trustee Services of Virginia, LLC, the appointed Substitute Trustee, will offer for sale at public auction at the front of the Circuit Court for the City of Virginia Beach, Building 10, Judicial Center, 2425 Nimmo Parkway, Virginia Beach, Virginia on July 31, 2018 at 2:00 PM the property more particularly described in the aforementioned Deed of Trust, located at the property address listed below and briefly identified as follows: ALL THAT certain lot or parcel of land, situate in the Bayside Borough of the City of Virginia Beach, formerly Princess Anne County, State of Virginia, particularly described as follows: BEGINNING at a pin on the south side of a road, now known as Funnell Street, to Bayside Road, a corner of land formerly J.P. Lambert's 3.89 acre tract and the land hereby conveyed, thence South 32 degrees 43' East 150.9 feet along the south side of the aforesaid road to a pin; thence South 51 degrees 09' West 376.8 feet to a sweet gum; thence the same course 19.6 feet to a pin in the northern boundary of a 10 foot strip of land belonging to the City of Norfolk, separating the property herein conveyed from the waters of Lake Smith; thence westwardly along the northern boundary of said 10 foot strip to a sweet gum; thence North 24 degrees 05' East 62.0 feet to a pipe; thence North 50 degrees 24' East 440.9 feet to a pin on the south side of the road to Bayside Road, the point of beginning, containing 1.54 acres, as shown on a plat entitled "Property of J. P. Lambert located near Bayside in Princess Anne County, Virginia, March 30, 1948, W. B. Gallup, County Surveyor" and duly recorded in the Clerk's Office of the Circuit Court of the City of Virginia Beach, Virginia in Map Book 22, at page 42. It being the same property conveyed to Scott Chierepko and Tammy Chierepko by deed from Stephen J. Donihee and Jean B. Donihee, dated April 5, 2007, and recorded April 10, 2007, as Instrument No 20070410000483750 in the aforesaid Clerk's Office. TERMS OF SALE: A non-refundable bidder's deposit of $62,000.00 or 10% of the sale price, whichever is less, by cashier's or certified check required at time of sale, except for the party secured by the Deed of Trust. Risk of loss is on the purchaser from date and time of auction. Balance of the purchase price must be paid by cashier's check within 14 days from sale date.
