Public Notice - Environmental Regulatory Variance PURPOSE OF NOTICE: To seek public comment on the tentative decision by the Director of the Dept. of Environmental Quality to grant a variance to regulatory requirements of the Virginia Solid Waste Management Regulations (VSWMR) regarding the Select Recycling Waste Services proposed materials recovery facility in Norfolk, Virginia. PUBLIC COMMENT PERIOD: December 27, 2018 to January 26, 2018. FACILITY NAME AND LOCATION: SRWS Norfolk Materials Recovery Facility located at 1525 Saint Julian Avenue. . PROJECT DESCRIPTION: SRWS has submitted a petition to the Director for a variance to the requirements of 9VAC20-81-320.C.1 regarding proximity of facility activities to the property boundary and 9VAC20-81-320.C.2 regarding proximity of facility operations to a residence or similar type public institution. Whereas 9VAC20-81-320.C.1 requires that no facility activity may be performed within SO- fee t of the facility boundary, the petitioner requests a reduction in this distance to 30-feet. Whereas 9VAC20-81-320.C.2 requires that no facility activity may be performed within 200-feet of a residence, healthcare facility, school, recreational park area, or similar type public institution, the petitioner requests a reduction in this distance to 50-feet. This petition has been submitted consistent with the requirements of 9 VAC20-81-760.A. The tentative decision to approve this petition for a variance is based on information submitted to the Department.
