PUBLIC HEARING The City of Portsmouth Board of Zoning Appeals will hold a public hearing on the following items at its regular monthly meeting on Wednesday, June 27, 2018 in the 6th Floor Conference Room, 801 Crawford Street, Portsmouth, VA. at 4:30 p.m. Jeffrey L. Kittle of Herman and Kittle, has filed an Administrative Appeal of a staff determination that building elevations submitted on February 8, 2018 for the proposed buildings at 4358 Greenwood Drive did not conform to the building elevations approved by City Council as a condition of HP-09-02. On March 24, 2009, City Council approved with conditions the development of Evergreen at Bethel (HP-09-02), a 234 unit apartment development on the northwest corner of Greenwood Drive and Tazwell Street. One of the conditions states that "The applicant shall design and construct the development in accordance to the site plan and elevations dated November 10, 2008." After reviewing and commenting on four submissions by Herman and Kittle to meet this condition, staff formally determined that the elevations submitted did not meet the elevations approved by Council. Herman and Kittle disagrees with the staff determination and believe that the latest submission on February 8, 2018 does conform to the approved elevations. On May 15, 2018 Herman and Kittle submitted an Appeal of this determination to the Board of Zoning Appeals. Information relative to the above described items are available for inspection in the City's Zoning Department, 4th Floor of City Hall, and 801 Crawford Street, Portsmouth, Virginia.
