NOTICE OF SUBSTITUTE TRUSTEE'S SALE 2835 Airline Boulevard, Portsmouth, VA 23701 Parcel ID No.: 05750040 By virtue of the power and authority contained in a Deed of Trust from E & A Whitley Enterprises, dated October 1, 2010, and recorded as Instrument No. 100009708 in the Clerk's Office of the Circuit Court for the City of Portsmouth, Virginia with an original principal balance of $270,000.00, the holder of the indebtedness secured by said Deed of Trust having appointed as Substitute Trustee KYLE D. KORTE and ANDREW B. GIBBS, by instrument duly executed, acknowledged and delivered, default having occurred under the terms thereof, and at the written request of the party secured thereby, the Substitute Trustee will offer for sale at public auction at the front steps of the Circuit Court for the City of Portsmouth, 1345 Court Street, Portsmouth, VA 23705-1217, on July 12, 2018 at 2:00 PM Improved real properties known as 2835 Airline Boulevard, Portsmouth, VA 23701, and more fully described as: All that certain lot, piece or parcel of land, situate in the City of Portsmouth, Virginia, and known, numbered and designated as Parcel "A-1" on that certain plat entitled "Resubdivision of a portion of Lot No. 3 Edmond Ballard Est.", dated January 29, 1970, made by E. Stuart Ball, C.L.S. and duly recorded in the Clerk's Office of the Circuit Court (formerly Hustings Court) for the City of Portsmouth in Map Book 6, page 69. TERMS OF SALE: Cash. A deposit of $30,000.00 or ten percent (10%) of the sale price, whichever is lower, in cash or certified check payable to the Substitute Trustee shall be required of the successful bidder at the time of sale before the bidding will be closed. The balance of the purchase price will be due within fifteen (15) days of the sale at the public auction. As-is.
