Pursuant to the terms of a deed of trust dated August 4, 2017, in the original principal amount of $140,409.00, recorded in the Clerk's Office of the Circuit Court of the City of Chesapeake, Virginia, in Deed Book 9820, Page 0035, as Instrument No. 170021666, as assigned by Noteholder by Assignment of Deed of Trust, recorded September 19, 2022, in Deed Book 10602, Page 0484, as Instrument No. 220029278, the property briefly described below will be offered for sale at public auction:
ALL THAT certain lot of land situate in the Deep Creek Magisterial District of Norfolk County, Virginia, and known, numbered and designated as Lot Twelve (12) on the Replat of Loxley Gardens, dated October 1953, and duly recorded in the Clerk's Office of the Circuit Court of the City of Norfolk County in Map Book 36, Pages 14 and 15, and as more particularly described in the referenced deed of trust.
The sale will take place on APRIL 12, 2024 AT 2:30 P.M., at the front entrance to the building housing the Circuit Court of the City of Chesapeake, located at 307 Albemarle Drive, Chesapeake, VA. The undersigned reserves the right to suspend bidding and/or to adjourn the bidding prior to the completion of sale.
The property and the improvements thereon will be sold "AS IS" and without representation or warranties of any kind. The sale is subject to all liens, encumbrances, conditions, easements and restrictions, if any, superior to the mentioned deed of trust and lawfully affecting the property.
Terms: A deposit in the form of CERTIFIED FUNDS in the amount of $10,000.00 (CASH NOT ACCEPTED) or 10% of the successful bid, whichever is lower, is required of any bidder at the time of sale. Closing within fifteen (15) days of sale. If the payment of the balance does not occur within fifteen days of sale, the deposit shall be retained by the Trustee as liquidated damages. Time is of the essence. Trustee has no duty to obtain possession for purchaser. The risk of loss or damage to the property passes to the purchaser immediately upon conclusion of the Substitute Trustee's sale. Purchaser to pay all closing costs, including cost of Trustee's Deed.
